That said, all products must contain 0.3% THC or less on a dry weight basis to be considered legal under Texas regulations and federal law. The “dry weight basis” addition to the definition of hemp has created a legal loophole for companies to sell hemp products that contain “less than 0.3% THC” that still cause intoxicating effects. 

Say, for example, a hemp-derived delta 9 THC edible weighs a total of 60 grams. If permitted to contain up to 0.3% THC, this technically means it would be allowed to contain up to 180 mg THC. 

Ultimately, it’s the way the Farm Bill defines hemp that’s changed the legal status of hemp-derived Delta 9 THC products in Texas.

Texas House Bill 1325, also referred to as the Hemp Farming Act of Texas, was signed into law by Texas Governor Greg Abbott in June 2019.
