Hemp-derived Delta 9 products have become more popular than ever.
Especially in states where recreational weed remains illegal.
Did you know Kansas is actually one of only three states in the nation that hasn’t legalized cannabis for recreational or medical purposes?
But what about hemp-derived Delta 9 products?
Is Delta 9 legal in the Sunflower State?
Let’s find out.
D9 THC & Federal Laws
Thanks to the 2018 Farm Bill, hemp and hemp derived products that contain less than 0.3% Delta 9 THC are legal at the federal level.
This has been the case since Dec 18, 2018, when the Farm Bill was officially approved by former President Donald Trump.
While the laws surrounding hemp and hemp-derived Delta 9 have remained constant for nearly half a decade, it’s expected that in late 2023 (when the Farm Bill is revised), there will be some big changes surrounding hemp and hemp-derived products.
We will definitely keep you updated on any changes that are made.
Kansas Delta 9 THC Laws
Even though hemp-derived Delta 9 is federally legal, states still have the power to ban the use of hemp products.
Thankfully for cannabis consumers in Kansas, the state made the decision to follow in the footsteps of federal law regarding legal hemp.
In 2018, Kansas created a program known as the Alternative Crop Research Act under Senate Bill 263.
Essentially this allows for the Kansas Department of Agriculture, either alone or with a higher education state institution, to grow and cultivate industrial hemp and promote its research and development.
In 2019, Kansas established further legislation under House Bill 2167 that was submitted to the USDA regarding how the Kansas State Department of Agriculture (KSDA) will monitor and regulate the commercial production of industrial hemp.
The Bill also established the Commercial Industrial Hemp Program, made changes to the Industrial Hemp Research Program, and established hemp processing registrations, prohibitions on specific products (smokable products like CBD flower and CBD vapes are prohibited), sentencing guidelines and waste disposal requirements.
The Definition of Hemp in KS
How is hemp defined in Kansas?
According to Kansas state law, hemp is defined as:
“Hemp products” means all products made from industrial hemp, including, but not limited to, cloth, cordage, fiber, food, fuel, paint, paper, particleboard, plastics, seed, seed meal and seed oil for consumption and any extract from industrial hemp intended for further processing. Final “hemp products” may contain a delta-9 tetrahydrocannabinol concentration of not more than 0.3%.
Basically this means that Kansas defines hemp pretty much the way it’s defined under federal law.
Is Delta 9 Controlled in Kansas?
Yes, Delta 9 is considered a controlled substance in Kansas unless it’s derived from hemp and the final product contains less than 0.3% Delta 9 THC by dry weight basis.
In certain states like Kansas, the possession of even small amounts of marijuana can lead to serious legal consequences.
In some jurisdictions, for example, possessing marijuana is classified as a Class B misdemeanor, which can result in a maximum of six months in jail and a fine of up to $1,000 for first-time offenders.
However, if this isn’t your first offense, you may be charged with a class A misdemeanor, which carries more severe penalties.
If you are caught with over a pound, the consequences can be even more severe.
Possession of more than 450 grams of marijuana, can lead to a fine of up to $100,000, with penalties that can range from 10 months of probation up to 42 months in prison.
It’s important to understand the local laws and regulations regarding marijuana and hemp-derived Delta 9 possession to avoid any legal issues.
Delta 9 THC Possession Limits in Kansas
Delta 9 THC possession limits in Kansas aren’t specified as they follow federal law that state hemp-derived products cannot contain more than 0.3% THC.
This “less than 0.3% THC” definition of hemp created a legal loophole that essentially allows cannabis consumers to get high on hemp.
Consumers can possess any amount of hemp-derived Delta 9 THC products, as long as each product contains less than 0.3% THC by dry weight.
In Kansas, hemp state law reflects federal hemp laws, meaning hemp products that contain this legal limit of hemp-derived Delta 9 are good to go.
It is important to note, however, that marijuana is still illegal in Kansas. This means any products that contain Delta 9 derived from marijuana are also illegal.
Is Delta-9 Legal in Kansas In 2024?
Yes, Delta 9 is legal in Kansas as long as it is derived from hemp and contains no more than .03% Delta 9 THC on a dry weight basis.
