Kansas Delta 9 THC Laws

Even though hemp-derived Delta 9 is federally legal, states still have the power to ban the use of hemp products.

In 2019, Kansas established further legislation under House Bill 2167 that was submitted to the USDA regarding how the Kansas State Department of Agriculture (KSDA) will monitor and regulate the commercial production of industrial hemp. 

The Bill also established the Commercial Industrial Hemp Program, made changes to the Industrial Hemp Research Program, and established hemp processing registrations, prohibitions on specific products (smokable products like CBD flower and CBD vapes are prohibited), sentencing guidelines and waste disposal requirements.

The Definition of Hemp in KS 

How is hemp defined in Kansas? 

According to Kansas state law, hemp is defined as: 

“Hemp products” means all products made from industrial hemp, including, but not limited to, cloth, cordage, fiber, food, fuel, paint, paper, particleboard, plastics, seed, seed meal and seed oil for consumption and any extract from industrial hemp intended for further processing. Final “hemp products” may contain a delta-9 tetrahydrocannabinol concentration of not more than 0.3%. 

Basically this means that Kansas defines hemp pretty much the way it’s defined under federal law.

Is Delta 9 Controlled in Kansas?

Yes, Delta 9 is considered a controlled substance in Kansas unless it’s derived from hemp and the final product contains less than 0.3% Delta 9 THC by dry weight basis.

In certain states like Kansas, the possession of even small amounts of marijuana can lead to serious legal consequences. 

In some jurisdictions, for example, possessing marijuana is classified as a Class B misdemeanor, which can result in a maximum of six months in jail and a fine of up to $1,000 for first-time offenders.

Delta 9 THC possession limits in Kansas aren’t specified as they follow federal law that state hemp-derived products cannot contain more than 0.3% THC.
