Federal law and state laws aren’t always the same when it comes to Delta 9 THC.

When President Donald Trump signed the Farm Bill in 2018, it legalized hemp cultivation and hemp products at the federal level. But hemp Delta 9 is different from Delta 9 THC derived from marijuana.

According to federal law, Delta 9 THC is legal as long as its derived from hemp and contains less than 0.3% THC on a dry weight basis.

This loophole has opened the door for a flood of D9 products made from hemp that contain enough THC “on a dry weight basis” to get you high.

It’s likely we’ll see some changes in 2023, however, when the Farm Bill is updated.

Nebraska Delta 9 THC Laws

Although hemp is legal federally, states are free to make their own laws when it comes to cannabis. Nebraska’s governor Pete Ricketts signed the LB657 Nebraska Hemp Farming Act in 2018.

I’ve summarized the highlights for you below in simple, stoner terms.

LB657 2-503 — Terms

(10) This section defines “handle” or “handling” as possessing or storing hemp plants on premises owned, operated, or controlled by a person licensed to cultivate or process hemp. “Handle” or “handling” also includes storing hemp plants in a vehicle unless during actual transport from one licensed person to another licensed person to cultivate or process hemp. It does not include transporting finished hemp products.

(11) The act only makes Delta 9 THC legal when it is derived from hemp, which is define as “the plant cannabis sativa and any part of the plant cannabis sativa, including viable seeds and all hemp derivatives, hemp extracts, hemp cannabinoids, hemp isomers, hemp acids, hemp salts, and hemp salts of isomers, even if they’re not currently growing, with a Delta 9 tetrahydrocannabinol concentration of no more than 0.3% on a dry weight basis.”

LB657 2-514 — Testing

(1) This section requires hemp from every cultivation site registered with the department to be tested at an approved testing facility prior to harvest at the licensee’s expense. Test results then must be certified directly to the department by the testing facility prior to harvest.

In sum, the act made hemp based products and hemp derivatives legal in Nebraska.

The good news is that this includes Delta 9 THC, the most commonly occurring cannabinoid in the cannabis plant, famous for the euphoric effect you experience when you hit a joint, take a dab or eat an eddy.

Is Delta 9 A Controlled Substance in Nebraska?

As long as Delta 9 THC is derived from hemp, Delta 9 isn’t considered a controlled, illegal substance in the Tree Planter State.

LB657 Nebraska Hemp Farming Act Section 2-503(11) states that hemp is an agricultural commodity. Notwithstanding any other provision of law, hemp is not considered a controlled substance under the Uniform Controlled Substances Act.

Hemp is considered an agricultural commodity, not an illegal drug at the federal level because the Farm Bill removed hemp from the federal Controlled Substances Act.

Delta 9 derived from hemp is good to go in Nebraska, but if you get caught with marijuana you will be fined and serve possible time. Anything less than a pound is considered a misdeamenor, anything over is considered a Class IV felony.
