Is Delta 9 legal in Nebraska?

Delta 9 THC is legal in Nebraska as long as the Delta-9 THC product is hemp-derived and contains less than 0.3% Delta-9 THC on a dry weight basis.

Read on to learn more about the laws behind Delta 9 THC hemp products in Nebraska.

Delta 9 Federal Law

Federal law and state laws aren’t always the same when it comes to Delta 9 THC.

When President Donald Trump signed the Farm Bill in 2018, it legalized hemp cultivation and hemp products at the federal level. But hemp Delta 9 is different from Delta 9 THC derived from marijuana.

According to federal law, Delta 9 THC is legal as long as its derived from hemp and contains less than 0.3% THC on a dry weight basis.

This loophole has opened the door for a flood of D9 products made from hemp that contain enough THC “on a dry weight basis” to get you high.

It’s likely we’ll see some changes in 2023, however, when the Farm Bill is updated.

Nebraska Delta 9 THC Laws

Although hemp is legal federally, states are free to make their own laws when it comes to cannabis. Nebraska’s governor Pete Ricketts signed the LB657 Nebraska Hemp Farming Act in 2018.

I’ve summarized the highlights for you below in simple, stoner terms.

LB657 2-503 — Terms

(10) This section defines “handle” or “handling” as possessing or storing hemp plants on premises owned, operated, or controlled by a person licensed to cultivate or process hemp. “Handle” or “handling” also includes storing hemp plants in a vehicle unless during actual transport from one licensed person to another licensed person to cultivate or process hemp. It does not include transporting finished hemp products.

(11) The act only makes Delta 9 THC legal when it is derived from hemp, which is define as “the plant cannabis sativa and any part of the plant cannabis sativa, including viable seeds and all hemp derivatives, hemp extracts, hemp cannabinoids, hemp isomers, hemp acids, hemp salts, and hemp salts of isomers, even if they’re not currently growing, with a Delta 9 tetrahydrocannabinol concentration of no more than 0.3% on a dry weight basis.”

LB657 2-514 — Testing

(1) This section requires hemp from every cultivation site registered with the department to be tested at an approved testing facility prior to harvest at the licensee’s expense. Test results then must be certified directly to the department by the testing facility prior to harvest.

In sum, the act made hemp based products and hemp derivatives legal in Nebraska.

The good news is that this includes Delta 9 THC, the most commonly occurring cannabinoid in the cannabis plant, famous for the euphoric effect you experience when you hit a joint, take a dab or eat an eddy.

Is Delta 9 A Controlled Substance in Nebraska?

As long as Delta 9 THC is derived from hemp, Delta 9 isn’t considered a controlled, illegal substance in the Tree Planter State.

LB657 Nebraska Hemp Farming Act Section 2-503(11) states that hemp is an agricultural commodity. Notwithstanding any other provision of law, hemp is not considered a controlled substance under the Uniform Controlled Substances Act.

Hemp is considered an agricultural commodity, not an illegal drug at the federal level because the Farm Bill removed hemp from the federal Controlled Substances Act.

Delta 9 derived from hemp is good to go in Nebraska, but if you get caught with marijuana you will be fined and serve possible time. Anything less than a pound is considered a misdeamenor, anything over is considered a Class IV felony.

Is Delta 9 THC Legal in Nebraska?

In summary, yes! Hemp derived Delta 9 THC is legal in Nebraska as long as the final product contains less than 0.3% Delta 9 THC on a dry weight basis.

One of our favorite places for Delta 9 is Botany Farms. A small boutique-style company specializing in craft cannabis products, all their products are made in small batches to ensure quality.

Their Delta 9 gummies contain 10mg THC and 14mg CBD per gummy but have less than 0.3% Delta 9, making them well within the legal limit. They only come in watermelon, but tasted so good we didn’t mind there was only one flavor option.

Dusted in sugar and kept fresh in a resealable, childproof jar, these vegan gummies reminded us of a hybrid high. You can expect a surge of euphoric energy that will slowly fade into a state of relaxation and drowsiness.

They ship to all states, are sourced from US micro-farmers and use 100% organic cannabis for their products, which I absolutely adore.

The only thing I don’t love about Botany Farms is their strict no refund policy. Plus, products are only tested for cannabinoid potency, meaning the COA won’t contain any info about contaminant testing.

If you’re looking for Delta 9 products that hit hard, Delta Munchies is the brand for you. Offering some of the strongest products on the market but also less heavy-hitters for those with lower tolerances, Delta Munchies is easily one of our favs.

They’re also one of the safest brands we’ve ever seen. They proudly pursue total transparency. There’s QR codes that link you to COAs on all their products, which are tested by a third-party lab. They don’t specify who sources their hemp, though, which is a little weird.

Their Delta 9 gummies are simply fire. They’re crafted from full spectrum Delta 9 distillate and a blend of 10 other cannabinoids. With 10mg Delta 9 per gummy, these will have you high as a kite for hours. Even if you have a high tolerance like us.

They come in three flavors: Mango Crush, Strawberry Shortcake and Blue Dream. Each flavor is soft, chewy, exotic, and delicious, but our favorite was the Mango Crush. With 10mg of delta 9 per gummy, these were ridiculously delicious and got us stupid stoned.

One of our favorite things about Hometown Hero is that they donate a portion of the proceeds from each purchase to veterans in need. They also test each batch six times. I don’t even check to see if I unplugged my straightener that many times.

We tested out their Select Spectrum Edibles and D9 Crunch Squares. Both are made of a special blend of full spectrum hemp derived cannabinoids and terpenes, containing a 1:1 THC:CBD ratio.

The gummies come in the flavors Strawberry, Pineapple and Mango. Our personal fav was Pineapple, which left us with a good body and mind high that lasted for hours.

The Crunch Squares really took us back. Offered in the flavors Rainbow and Cinna Crunch, these literally feel like eating a bowl of sugary cereal but getting a beautiful high instead of a sugar rush headache. With 200mg Delta 9 per square, these are more than worth the $40 they cost.

An online retailer based in Louisiana, this is the least expensive option on our list. We tested out their Delta 9 Canna Moon gummies and Extra Strength Delta 9 Canna Moon gummies.

While the Extra Strength version should really only be consumed by users with a high tolerance, the Delta 9 Canna Moons contain 12mg THC + 5mg CBD per gummy and are suitable for both those just starting their relationship with Delta 9 and those more experienced.

They come in the flavors Blue Raspberry, Green Apple and Peach. The peach flavor was our personal fav, but all have a naturally sweet flavor. Plus, they’re vegan, gluten free, and non-GMO. It’s hard to ask for more.

You can expect a euphoric, well-balanced high while still being able to function from these delish D9 treats.
